Acceptance of terms and conditions: By accessing HANA Communications WEB pages you agree to the terms and conditions following. If you disagree with any part of the following terms, you are not allowed to use or access this site.

Amendment of terms and conditions: These terms and conditions may be amended in whole or in part by HANA Communications from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Services represents your agreement to be bound by the terms and conditions as amended.

Provision of the Services by HANA Communications: HANA Communications is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which HANA Communications provides may change from time to time without prior notice to you.

As part of this continuing innovation, you acknowledge and agree that HANA Communications may stop (permanently or temporarily) providing any features within the Services to you or to users generally at HANA Communications’ sole discretion, without prior notice to you. You may stop using the Services at any time.

You acknowledge and agree that if HANA Communications disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.

You acknowledge and agree that while HANA Communications may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services or on the amount of storage space used for the provision of any Service, such fixed upper limits may be set by HANA Communications at any time, at HANA Communications’ discretion.

Your Passwords and Account Security: You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with the account you use to access the Services.

Accordingly, you agree that you will be solely responsible to HANA Communications for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify HANA Communications immediately at support@hanacom.co.nz

Content in the Services: The contents of HANA Communications WEB and WAP pages are Copyright © 2014 HANA Communications Limited. Any rights not expressly granted herein are reserved. You may not, reproduce, store, copy, distribute, modify, transmit, reuse or deface any part of any HANA Communications WEB and WAP pages.

You should be aware that Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to HANA Communications (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by HANA Communications or by the owners of that Content, in a separate agreement.

You agree that you are solely responsible for (and that HANA Communications has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Services and for the consequences of your actions (including any loss or damage which HANA Communications may suffer) by doing so.

Links in the Services: HANA Communications may include links to sites on the Internet that are outside of HANA Communications WEB or WAP site and owned or operated by other parties. By linking to such other sites, you shall review and agree to that site’s rules of use before using such sites. You also agree that HANA Communications has no control over the content of that site and cannot assume any responsibility for material created or published by such other sites. In addition, a link to a non-HANA Communications site does not imply that HANA Communications endorses the site or the products or services referenced in such other site.

Refunds Policy: This follows to each services’ refund policy. For the services including Domain registration, transfer, renewal, and SSL Certificates provided by TPP Wholesale, we abide by whatever rules TPP Wholesale apply to the services.

Charges for services related to Domain Names, once registered with the relevant authorities, cannot be refunded for any reasons (spelling, fraud, change of mind etc.) as this is outside of HANA Communications’ control.

Charges for Reseller Hosting Plans, 14 days money back guarantee if a plan you paid is not satisfactory and does not meet your requirements.

Fair Usage Policy (High-Limit / Unlimited Hosting)
HANA Communications offers Hosting Packages with high-limit or unlimited amounts of disk space and/or other resources, such as bandwidth transfer, email or FTP accounts. It is acknowledged by users that these resource allotments are optimized and dedicated to serving web documents and self-need email services and are not to be used as a storage area for electronic files, or as a provisioning service for 3rd party email or FTP hosts. All downloadable files or files stored on the server must be available for download via an HTML document stored on hosted account in a publicly accessible area and must be directly related to the general nature of the website index.

Following (including but not limited to), is NOT PERMITTED.

Use of the hosting as a virtual disk, or in other words, as a space for files that are not elements of your website.
Hosting of Web Portals and/or subscription-based services.
Illegal content includes, but is not limited to pirated software, music, films, applications or other media stored in any file format or extension. Online storage of file achieves, backups, documents, log files etc.
FTP Service / File Sharing services.
Use of hosting as a “mirror” for other websites.
Sharing of your account.

Having high-limit or unlimited access to resources does not mean, that you can use your hosting in such a way that it negatively affects the server operation, for illegal purposes or in any way that violates applicable legislation.

Privacy and your personal information: HANA Communications collects personal information about you through your use of the Services, including:

Your registration details; and
information relating to your use of the Website and the content you access.
You agree that HANA Communications may use this personal information to assist us to provide the Services to you, for internal research purposes, to verify your identity, for promoting and marketing other HANA Communications products and Services to you, and for any other use that you authorise.

We will not sell or allow third parties to access your personal information without your consent.
